eGift Card Terms and Conditions

  1. General Terms

    M·A·C eGift Cards are issued by Estee Lauder Cosmetics Ltd. (“ELC”), a Canadian limited liability company, and distributed by CashStar Inc., a Delaware corporation ("CashStar"). Your use of this website is subject to the terms and conditions set forth below (the “Terms and Conditions”), the CashStar Privacy Policy and the additional terms and conditions at www.maccosmetics.ca, including, without limitation, the M·A·C Privacy Policy. The Terms and Conditions set forth below at this website and/or at www.maccosmetics.ca may be updated or modified at any time without prior notice. Neither The Estee Lauder Companies Inc. nor any of its subsidiaries or affiliates other than Estee Lauder Cosmetics Ltd. shall be liable to any holder of a M·A·C eGift Card.
  2. Redemption

    M·A·C eGift Cards can be used as payment for purchases made online at www.maccosmetics.com, www.maccosmetics.ca and at company-owned freestanding M∙A∙C Stores in the United States, Canada and Puerto Rico. M·A·C eGift Cards cannot be used as payment in department stores. Regardless of where redeemed, the value of your eGift card will be based on the currency of the location where it was purchased and the exchange rate on the date of redemption. eGift Cards cannot be used to pay a credit account, and cannot be exchanged or redeemed for cash, except as required by law. For M∙A∙C retail store locations, please call 1.800.588.0070 or visit www.maccosmetics.com or www.maccosmetics.ca. Refunds for returned items purchased with a M·A·C eGift Card will be credited to the original payment method.
  3. Expiration and Service Fees

    M·A·C eGift Cards have no expiration date and no service fees.
  4. View Your Balance

    To view your eGift Card balance, visit https://www.maccosmetics.ca/giftcards/balance.tmpl or Customer Support
  5. Returns

    You may not return or cancel your eGift Card after it is sent to the recipient. Purchasers who wish to cancel an order foran eGift Card may do so prior to the delivery date selected during the order process by contacting Customer Support.
  6. Lost or Stolen eGift Cards

    Please safeguard your eGift Card. If your eGift card is lost or stolen, you should immediately contact Customer Support. We will replace unredeemed eGift Cards that are lost or stolen only if the purchaser’s confirmation email is presented as proof of purchase.
  7. Limitations

    Promotional offers and discounts may not be applied to the purchase of eGift Cards, and purchases of eGift Cards will not be used to satisfy promotional thresholds.
  8. Risk of Loss

    Ownership and risk of loss with respect to eGift Cards passes to the purchaser once we send an email notification to the recipient. Except as otherwise provided herein, neither CashStar nor ELC is responsible for lost or stolen eGift Cards.
  9. Customer Service

    If you need assistance of any kind concerning the purchase, ownership, or use of an eGift Card, please contact Customer Support. Please be ready to provide your order number or email address.
  10. Payment Methods

    eGift Cards may be purchased with a valid VISA, MasterCard, Discover, or American Express, or by using PayPal.
  11. Delivery Information and Requirements for eGift Card Purchasers

    We are not responsible for eGift Cards that are undeliverable or not received due to your failure to correctly enter the recipient’s email address. Please check to make sure the email address of the recipient is correct and contact Customer Support if you suspect the recipient did not receive his/her eGift Card. Should an email be returned to us due to inaccurate delivery information for the recipient, we will attempt to contact you for a valid email address.
    Sometimes a recipient's email address is correct, but he or she does not access the eGift Card within a reasonable period after the requested delivery date. The following is a list of the most common reasons why this may occur:
    • Spam filter blocked email or routed it to a bulk/spam folder
    • Recipient's firewall blocked the email
    • Email inbox is over size limit

    Please ensure that the recipient’s spam filter does not block giftcards@cashstar.com emails.
    NOTE: Orders may be delayed in the event of a discrepancy between the purchaser’s information provided to CashStar and information provided by the purchaser's financial institution. If you do not receive confirmation that your eGift Card was sent by the requested date, please contact Customer Support. You will be asked to provide your order number or email address.
  12. Personalized Messaging

    If you wish to add a personal message when purchasing an eGift Card, simply type your message in the Message Field on the eGift Card preview. Personal messages are limited in length to the space provided on the eGift Card. There is no additional charge to include a personalized message. We reserve the right to remove or replace inappropriate, offensive or otherwise objectionable messages.
  13. Uploaded Images or videos

    We reserve the right to replace images or videos that infringe upon trademark or copyright law. As part of your electronic gift card purchase, you (or, if you are under 18 years old, your parent or legal guardian) hereby grant to M·A·C Cosmetics and CashStar and their affiliates and agents a nonexclusive, royalty free, worldwide license to use the uploaded image or video, including all intellectual property rights associated with the uploaded image or video, to create an electronic gift card of the uploaded image or video (the "License"). You, (or, if you are under 18 years old, your parent or legal guardian) represent and warrant that (1) your grant of the License does not violate the privacy rights, publicity rights, copyrights, trademarks, contract rights or any other rights of any person or entity, and (2) you have full authority and rights to grant the License and to make the representations and warranties contained herein. CashStar reserves the right to cancel any order for an image or video that it, in its sole discretion, deems potentially unlawful or inappropriate without notice or explanation. We reserve the right to replace inappropriate, offensive, or otherwise objectionable images or video.
  14. Privacy

    CashStar may provide eGift Card purchasers with information about the receipt and redemption status of eGift Cards. Please review the CashStar Privacy Policy for details about our personal information practices.
  15. Limitation of Liability

    THE LAWS OF CERTAIN JURISDICTIONS (SUCH AS QUEBEC) DO NOT ALLOW THE EXCLUSION OR LIMITATION OF WARRANTIES, LIMITATIONS OF LIABILITY OR CERTAIN DAMAGES. IF THESE LAWS APPLY TO YOU, SOME OR ALL OF THE BELOW EXCLUSIONS OR LIMITATIONS MAY NOT APPLY TO YOU AND YOU MAY HAVE ADDITIONAL RIGHTS. The materials on the website are provided "as is." To the extent permitted by law, we make no warranties of any kind, either express or implied, with respect to any materials on the website or the M·A·C eGift Cards, including without limitation, warranties of title, merchantability, fitness for a particular purpose or non-infringement of intellectual property. Your use of the website is at your sole risk, and you assume full responsibility for any costs associated with your use of the website. Neither ELC nor CashStar shall be liable to you for any damages resulting from your use of the website. If an eGift Card is non-functional, your sole remedy, and our sole liability, shall be replacement of such eGift Card.
  16. Disputes

    This section applies unless the laws of your jurisdiction do not allow limitations on a consumer’s right to go before a court (such as in Quebec). Mindful of the high cost of litigation, not only in dollars but also in time and energy, you and we agree to the following dispute resolution procedure: In the event of any controversy, claim, action or dispute arising out of or related to any transaction conducted on the website, an eGift Card, or the breach, enforcement, interpretation, or validity of these Terms and Conditions or any part of it ("Dispute"), the party asserting the Dispute shall first try in good faith to settle such Dispute by providing written notice to the other party(s) (by first class or registered mail) describing the facts and circumstances (including any relevant documentation) of the Dispute and allowing the receiving party 30 days in which to respond to or settle the Dispute. Notice shall be sent to:

    You and we agree that this dispute resolution procedure is a condition precedent which must be satisfied prior to initiating any litigation or filing any claim against the other party.
  17. Choice of Law

    This section applies unless the laws of your jurisdiction require that those laws apply (such as in Quebec). These Terms and Conditions shall be governed by and construed in accordance with the substantive laws of the province of Ontario and the laws of Canada applicable therein, without regard to any conflict of law provisions. You and we agree that any dispute arising under these Terms and Conditions shall be resolved exclusively by the courts in the Province of Ontario, and you submit to the exclusive jurisdiction of the courts in the Province of Ontario. The waiver of any provision of the Agreement shall not be considered a waiver of any other provision or of our right to require strict observance of each of the terms herein. If any provision of these Terms and Conditions is found to be unenforceable or invalid for any reason, that provision shall be severable, and all other provisions shall remain in full force and effect.
